12.09.2025-BONELA RESPONSE TO CIRCULATING VIDEO OF WOMAN ASSAULTED IN PRESENCE OF MINOR CHILDREN

  1. BONELA notes reports of an assault of a woman, as captured on video in the presence of minor children, by a person reported to be a public prosecutor based in Lobatse. We understand the suspect has been apprehended by the police. Apprehension alone is not sufficient. Authorities must ensure lawful detention pending first appearance, promptly prefer appropriate charges, and the State must oppose bail and seek remand in custody. In too many GBV cases, women who had previously reported abuse were later killed after the accused was released on bail following an assault or a breach of a protection order. Bail cannot be the default where lethality indicators are present. We condemn not only this incident but the many others like it that occur behind closed doors, this case is visible precisely because it was captured on video.

  2. This matter is not only about the adult victim. It is equally about the minor children, who must be recognised and treated as children in need of protection under the Children’s Act, where the best interests of the child are paramount. Exposure to GBV is harmful and requires urgent, coordinated child-safeguarding measures. Where children witness or are exposed to violence, child-protection measures must be activated immediately, and bail should be denied where risk is established.

  3. BONELA notes that the Law Society of Botswana has confirmed receipt of this matter and is investigating. Given the seriousness of the matter, including violence in the presence of children, BONELA’s position is that the Law Society should recommend disarmament of this individual on the basis that he is not a fit and proper person to practise, subject to due process. Officers of the court who perpetrate GBV cannot be associated with the noble profession or entrusted to administer justice.

  4. BONELA will continue to monitor the matter and stands ready to support a coordinated, lawful response that centres safety, accountability and the rule of law.
